Garmin�s n�vi�-a-day-at-CES Sweepstakes OFFICIAL RULES NO PURCHASE NECESSARY TO ENTER OR WIN. MUST BE 18 YEARS OF AGE OR OLDER TO ENTER. VOID IN RHODE ISLAND AND WHERE PROHIBITED BY LAW. Sweepstakes Description: In conjunction with a Garmin-hosted weblog (blog) featuring its n�vi� product in use at the January 2006 Consumer Electronics Show in Las Vegas, Nevada, Garmin will host a random drawing to give away one (1) free n�vi per day from January 5, 2006 through January 8, 2006. To be eligible for each day�s random drawing, participants must visit the Garmin n�vi blog site and complete the on-line entry form to register for the drawings. Only one entry is necessary to be eligible for all remaining drawings. 1. ELIGIBILITY: The Sweepstakes is open only to individuals who are legal residents of the fifty (50) United States (with the exception of Rhode Island) or the District of Columbia and are eighteen (18) years of age or older at the time of entry. Employees and their immediate families of Garmin International, Inc. and any of its affiliated companies are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. 2. AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant�s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Garmin, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein in a timely manner. 3. SWEEPSTAKES TERM: The Sweepstakes begins at 2:00 p.m. Central Standard Time (�CST�) on January 3, 2006 and ends at 11:59 p.m. CST on January 8, 2006. Entries received prior to or after the Sweepstakes Term will be disqualified. 4. ENTRY: Visit http://www.garmin.com/nuvicontest/ and complete the online entry form. Garmin and its affiliates do not assume any responsibility with lost entries or any computer, internet, or technical malfunctions that might occur during the entry process. You will be required to provide your first and last name, mailing address, email address, date of birth, and daytime phone number in order to submit an entry form. (You may also be asked a few optional market research questions, which are not required for Sweepstakes entry). THERE IS A LIMIT OF ONE (1) ENTRY PER PERSON. Only one entry is necessary to be eligible for all drawings remaining before the final drawing on January 8, 2006. Upon submission of an entry, the contestant is eligible for that day�s drawing (beginning on January 5, 2006) and any drawings that remain before the final drawing on January 8, 2006. 5. PRIZES: PRIZES: Garmin will award one (1) new n�vi per day during the period of January 5, 2006 through January 8, 2006 (four (4) free n�vi�s to be given away in total). Each n�vi awarded has an approximate retail value of $969. Each Prize winner will be eligible to win one (1) Prize only throughout the duration of the Sweepstakes. FOR ALL PRIZES: Prizes are nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Garmin, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by Garmin in its sole discretion. Winners are responsible for all taxes associated with receipt of the Prize. 6. DRAWING: All Prizes will be awarded by a random drawing only. Garmin will select winners in a random drawing of all complete entries received during each day of the four-day Sweepstakes Term. Odds of winning depend on the number of eligible entries received. Garmin will attempt to notify the potential winner by phone, e-mail, and/or written mail within seven (7) days of the drawing. If a winner cannot be located or does not respond within a reasonable time, the Prize will automatically be forfeited and an alternate winner will be drawn. 7. REQUIREMENTS OF THE POTENTIAL WINNER: Except where prohibited by law, potential winners will be required to complete and return an affidavit of eligibility and liability/publicity release (the �Affidavit/Release�) within ten (10) days of being notified. If a potential winner fails to sign and return the Affidavit/Release postmarked within the required time period, an alternate entrant may be selected in his/her place in a random drawing of all entries received on the day in question. 8. GENERAL CONDITIONS: Garmin reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Sweepstakes, as determined by Garmin in its sole discretion. In such event, Garmin reserves the right to award the Prizes at random from among the eligible entries received up to the time of the impairment. Garmin reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Garmin reserves the right to seek damages from any such person to the fullest extent permitted by law. Garmin�s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The �authorized account holder� is the natural person assigned an email address by an Internet service provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. 9. PUBLICITY: Except in Tennessee and where prohibited by law, participation in the Sweepstakes constitutes the winner�s consent to Garmin�s use of winner�s name, likeness, photograph, voice, and state of residence for promotional purposes in any media without further payment or consideration. 10. PRIVACY: All information submitted by entrants as part of this Sweepstakes will be treated in accordance with Garmin�s Privacy Policy, which is accessible from www.garmin.com. 11. LIMITATIONS OF LIABILITY: Garmin and its affiliates and employees are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Sweepstakes; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrant�s participation in the Sweepstakes or receipt of any prize. 12. DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Sweepstakes, but in no event attorneys� fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant�s rights and obligations, or the rights and obligations of the Garmin in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Kansas. 13.
