Garmin Garage Background: The Garmin Garage (located at http://www8.garmin.com/vehicles/) is where one can find a variety of vehicle icons to personalize his or her Garmin navigation device.

Contest Description: To celebrate the one millionth vehicle icon downloaded from the Garmin Garage, Garmin is holding a contest to determine who can design the best vehicle icon to be included in the Garmin Garage. Each week during the Contest Term, Garmin will select five (5) finalists from among the contestants who submit a qualifying vehicle icon that week. Each of the five (5) weekly finalists will receive a Garmin Garage t-shirt. At the end of the fourth week of the Contest Term, the vehicle icons submitted by each of the five (5) weekly finalists (a total of 20 finalists) will be posted to http://www.garmin.com/vehicles/mechanic. The winning vehicle icon will be chosen from among the 20 finalists by an internet vote of the public to be held from May 19-28. The person submitting the vehicle icon that receives the most internet votes during the voting period will win a Garmin nüvi® 205, which will come loaded with the winning vehicle icon. The winning vehicle icon will be included in the Garmin Garage and will be available for download for a period of time.

1. ELIGIBILITY: The Contest is open only to individuals who are legal residents of the fifty (50) United States (excluding Puerto Rico) or the District of Columbia and are eighteen (18) years of age or older at the time of entry. Employees and their immediate families of Garmin International, Inc. and any of its affiliated companies are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
2. AGREEMENT TO OFFICIAL RULES: Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Garmin, which are final and binding.
3. CONTEST TERM: The Contest begins at 12:00 p.m. Central Time (“CST”) on Monday, April 21, 2008 and will continue until 11:59 a.m. CST on Sunday, May 18, 2008 (the “Contest Term”). Entries received prior to or after the Contest Term will be disqualified.
4. ENTRY: NO PURCHASE IS NECESSARY. Each contestant may submit an entry by visiting http://www.garmin.com/vehicles/mechanic to design and submit a vehicle icon. Contestants must follow the instructions for submitting a Contest Entry Form at http://www.garmin.com/vehicles/mechanic/submit.jsp. Garmin and its affiliates do not assume any responsibility for any lost entries or any computer, internet, or technical malfunctions that might occur during the entry process. Each eligible entry is eligible for judging during that weekly period only. For purposes of this Contest, the weekly period shall mean the period from Monday at 12:00 p.m. CST through the following Monday at 11:59 a.m. CST. Each person is eligible to win only once (one t-shirt) throughout the Contest Term, however, contestants are free to enter new entries in separate weeks if they wish. Entries containing defamatory, libelous, infringing, obscene, harassing, or other unlawful material or content will be rejected by Garmin at its discretion.
5. PRIZES: Five (5) limited-edition Garmin Garage t-shirts will be awarded each week during the Contest Term to the five (5) weekly finalists. Each t-shirt awarded has an approximate retail value of $15. No person can win more than one (1) t-shirt throughout the Contest Term. One (1) grand prize winner will be chosen among the 20 total weekly finalists, and the grand prize winner will be awarded a Garmin nüvi® 205, which has an approximate retail value of $199.99.
   Prizes are nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Garmin, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by Garmin in its sole discretion. Winners are responsible for any taxes associated with receipt of the Prize.
6. JUDGING CRITERIA: The five (5) weekly finalists will be chosen by Garmin at Garmin’s discretion based upon subjective factors such as creativity, uniqueness, appeal, appropriateness and innovation. Odds of winning depend on the number of eligible entries received during each weekly period. Weekly finalists will be announced via the http://www.garmin.com/vehicles/mechanic site once per week during the Contest Term. The 20 vehicle icons submitted by the 20 total weekly finalists will be posted on http://www.garmin.com/vehicles/mechanic on Monday, May 19, 2008. The grand prize winner will be chosen by means of a public internet vote to be held during the May 19-28 time period. Garmin will oversee the internet vote, and the results of the internet vote are final.
7. GENERAL CONDITIONS: Garmin reserves the right to cancel, suspend, and/or modify the Contest if any fraud, virus, or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by Garmin in its sole discretion. Garmin reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law. Garmin’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
8. OWNERSHIP AND PUBLICITY: Except where prohibited by law, participation in the Contest constitutes each Prize winner’s consent to Garmin’s use of each Prize winner’s name, likeness, photograph, voice, vehicle icon, and state of residence for promotional or marketing purposes in any media without further payment or consideration. All ownership rights in and to the vehicle icons submitted by contestants shall reside in Garmin. The vehicle icons submitted by contestants may be posted on Garmin websites for public viewing.
9. LIMITATIONS OF LIABILITY: Garmin and its affiliates and employees are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Contest; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Contest or the processing of entries; or (e) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize.
10. DISPUTES: Except where prohibited by law, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contest, but in no event attorneys’ fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Garmin in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of Kansas.
