Team Garmin Edge® Sweepstakes Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. MUST BE 18 YEARS OF AGE OR OLDER TO ENTER. VOID WHERE PROHIBITED BY LAW.
1. SWEEPSTAKES DESCRIPTION: Garmin International, Inc. (“Garmin”) will sponsor a random drawing to give away the prizes described in paragraph 6 below on or about August 18, 2008. To be eligible for a chance to win a Prize, participants must visit the website www.garmin.com/teamgarmin to complete the online entry form and must meet the other eligibility requirements set forth herein. No purchase is necessary to enter the Sweepstakes.
2. ELIGIBILITY: The Sweepstakes is open only to individuals who are legal residents of the fifty (50) United States (with the exception of Rhode Island) or the District of Columbia and are eighteen (18) years of age or older at the time of entry. Employees and their immediate families of Garmin (and any of its affiliated companies), Chipotle, Felt and Slipstream Sports are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
3. AGREEMENT TO OFFICIAL RULES: Entry constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Garmin, which are final and binding. Winning a Prize is contingent upon fulfilling all requirements set forth herein in a timely manner.
4. SWEEPSTAKES TERM: The Sweepstakes begins at 12:01 a.m. Central Time (“CT”) on July 5, 2008 and ends at 11:59 p.m. CT on August 15, 2008. Entries received prior to or after the Sweepstakes Term will be disqualified. Garmin’s website is the official timekeeping device for the Sweepstakes Term.
5. ENTRY: Visit www.garmin.com/teamgarmin and complete the online entry form. You may be required to provide your first and last name, mailing address, email address, date of birth and daytime phone number. You will also have an option to voluntarily answer some market research questions, but answering these questions is not required to enter the Sweepstakes and doing so will not increase your odds of winning a Prize. THERE IS A LIMIT OF ONE (1) ENTRY PER PERSON. Any attempt by any person to obtain more than one entry by using multiple/different e-mail addresses, identities, logins, or any other methods will void that participant’s entries and will result in the disqualification of that participant.
6. PRIZES: The prizes to be given away in the Sweepstakes (collectively, the “Prizes”, and individually, a or the “Prize”) are the following:
ONE (1) GRAND PRIZE: One (1) grand prize winner will receive a 2009 Felt Z35 bicycle, which has an approximate retail value of $2200.
FIVE (5) FIRST PRIZES: Five (5) first place winners will each receive a customized Garmin Edge® 705 unit, complete with heart rate monitor and speed cadence sensor. Each of these units has an approximate retail value of $499.99.
FIVE (5) SECOND PRIZES: Five (5) second place winners will each receive a Team Garmin kit, which includes a jersey, bib shorts, gloves and socks. Each of these kits has an approximate retail value of $274.99.
TWENTY (20) THIRD PRIZES: Twenty (20) third place winners will each receive a deck of fifty-two (52) cards entitling them to redeem one of the cards per week for fifty-two (52) consecutive weeks at any Chipotle restaurant for a standard dress burrito of their choice. Each of these decks of cards has an approximate retail value of $500.
Prizes are nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Garmin, who reserves the right to substitute a Prize with another prize of equal or greater value if the Prize is not available for any reason as determined by Garmin in its sole discretion. Winners are responsible for any and all taxes associated with receipt of a Prize.
7. DRAWING: Potential winners of the Prizes will be chosen in a random drawing from the pool of valid entries on or about August 18, 2008. The random drawing will be conducted by one or more employees of Garmin or an independent fulfillment entity. Garmin will attempt to notify the potential winners by phone, e-mail, and/or written mail within seven (7) business days of the drawing. If a winner of a Prize cannot be located or does not respond within seven (7) business days of contact from Garmin, the Prize will automatically be forfeited and an alternate potential winner will be drawn from the pool of remaining valid entries.
8. REQUIREMENTS OF THE POTENTIAL WINNERS: Except where prohibited by law, potential winners might be required by Garmin to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within seven (7) days of being notified. If a potential winner fails to sign and return the Affidavit/Release, if required by Garmin, postmarked within the required time period, an alternate potential winner may be selected in his/her place in a random drawing of all remaining valid entries.
9. GENERAL CONDITIONS: Garmin, Chipotle, Felt and Slipstream Sports and their respective affiliates and employees are not responsible for late, lost, incomplete, or misdirected entries or communications or for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, internet service providers, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Garmin is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. The use of automated software or computer programs to enter the Sweepstakes is prohibited and any individual who uses or attempts to use such methods to register will be disqualified. Garmin disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Sweepstakes. Garmin reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, virus, bug, technical failure, unauthorized human intervention or other causes beyond Garmin’s control corrupt the administration, security, or proper play of the Sweepstakes, as determined by Garmin in its sole discretion. In such event, Garmin reserves the right to award the Prizes in a random drawing from among the pool of valid entries submitted up to the time of the impairment. Garmin reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Garmin reserves the right to seek damages from any such person to the fullest extent permitted by law. Garmin’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet service provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
10. PUBLICITY: Except in Tennessee and where prohibited by law, participation in the Sweepstakes constitutes the winner’s consent to Garmin’s use of each winner’s name, photo, likeness and state of residence for promotional purposes in any media without further payment or consideration.
11. PRIVACY: All information submitted by entrants as part of this Sweepstakes will be treated in accordance with Garmin’s Privacy Policy, which is accessible from www.garmin.com.
12. LIMITATIONS OF LIABILITY: Garmin and its affiliates, officers, directors, employees and agents are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Sweepstakes; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any Prize.
13. DISPUTES: Except where prohibited by law, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Sweepstakes, but in no event attorneys’ fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of Garmin in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Kansas.
14. OFFICIAL RULES AND WINNERS LIST: A copy of these Official Rules will be posted on www.garmin.com/teamgarmin. You can obtain Sweepstakes winners and a copy of these Official Rules by sending a self-addressed, stamped envelope to Garmin International, Inc., Attn: Marketing Communications, 1200 East 151st Street, Olathe, Kansas 66062. Vermont residents may omit return postage for Official Rules requests.
