Garmin’s “24” Day 7 Blog Sweepstakes

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. MUST BE 18 YEARS OF AGE OR OLDER TO ENTER. VOID IN RHODE ISLAND AND WHERE PROHIBITED BY LAW.

1. SWEEPSTAKES DESCRIPTION: In conjunction with Garmin’s promotional relationship with Fox Broadcasting Company (“Fox”) related to Fox’s television show “24”, Garmin will sponsor four (4) weekly random drawings to give away tickets to an event to be held on Thursday, January 8, 2009 from 6-8 p.m. at the Garmin retail store located at 633 N. Michigan Ave., Chicago, IL at which a sneak preview of a portion of “24” Day 7 will be shown. To be eligible for a chance to win a Prize, participants must visit the Garmin blog site at www.garmin.blogs.com and complete the on-line entry form (which includes answering a trivia question or successfully completing a game). Participants who answer the trivia question correctly or successfully complete the game will be entered into the Sweepstakes. No purchase is necessary to enter the Sweepstakes, and making a purchase will not increase your odds of winning a Prize.
2. ELIGIBILITY: The Sweepstakes is open only to individuals who are legal residents of the fifty (50) United States (with the exception of Rhode Island) or the District of Columbia and are eighteen (18) years of age or older at the time of entry. Employees and their immediate families of Garmin International, Inc. and Fox Broadcasting Company (Fox) and any of their respective affiliated companies are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
3. AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Garmin, which are final and binding. Winning a Prize is contingent upon fulfilling all requirements set forth herein in a timely manner.
4. SWEEPSTAKES TERM: The Sweepstakes begins at 8:00 a.m. Central Standard Time (“CST”) on December 8, 2008 and ends at 11:59 p.m. CST on January 1, 2009 (the “Sweepstakes Term”). Entries received prior to or after the Sweepstakes Term will be disqualified.
5. ENTRY: Visit www.garmin.blogs.com and complete the online entry form (which includes answering a trivia question or successfully completing a game). Garmin and its affiliates do not assume any responsibility with lost entries or any computer, internet, or technical malfunctions that might occur during the entry process. You may be required to provide your first and last name, mailing address, email address, date of birth, and daytime telephone number. Entries will be entered in all of the weekly drawings described in Paragraph 7 that are remaining at the time you submit your entry (i.e., if you enter before December 12, 2008, you are entered in all four (4) weekly drawings). You may only submit one (1) entry during the Sweepstakes Term and you can only win one (1) Prize during the Sweepstakes Term.
6. PRIZES:
   PRIZES: The Prize is defined as two (2) tickets to the event to be held on Thursday, January 8, 2009 from 6-8 p.m. at the Garmin retail store located at 633 N. Michigan Ave., Chicago, IL at which a sneak preview of a portion of “24” Day 7 will be shown (the “Event”). One (1) winner of each of the four (4) random drawings will win a Prize. A total of 4 Prizes (eight (8) tickets) to the Event will be awarded in this Sweepstakes.
   FOR ALL PRIZES: Prizes are nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made. Winners are responsible for paying all travel and accommodation expenses they might incur in connection with attending the Event and all taxes associated with receipt of the Prize. Winners will also be responsible for adhering to any and all Event rules and restrictions (such as no video cameras at the Event), which may be issued at the Event.
7. DRAWINGS: One or more employees of Garmin, or an independent fulfillment entity, will conduct four (4) random drawings as part of the Sweepstakes, to be held on or about December 12, 2008, December 19, 2008, December 26, 2008 and January 2, 2009. With respect to each drawing, the potential winner(s) of the Prize will be chosen in a random drawing from the pool of valid entries that were properly and timely submitted in accordance with paragraphs 4 and 5 above. Garmin will attempt to notify the potential winners by phone, e-mail, and/or written mail promptly following the drawing. If a winner of a Prize cannot be located or does not respond within two (2) days of contact from Garmin, the Prize may be forfeited and an alternate potential winner drawn from the pool of remaining valid entries.
8. REQUIREMENTS OF THE POTENTIAL WINNER: Except where prohibited by law, potential winners may be required to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within two (2) days of being notified. If a potential winner fails to sign and return the Affidavit/Release postmarked within the required time period, an alternate entrant may be selected in his/her place in a random drawing of all remaining valid entries.
9. GENERAL CONDITIONS: Garmin and its affiliates and employees are not responsible for late, lost, incomplete, or misdirected entries or communications or for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, internet service providers, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Garmin is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. The use of automated software or computer programs to enter the Sweepstakes is prohibited and any individual who uses or attempts to use such methods to register will be disqualified. Garmin disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Sweepstakes. Garmin reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, virus, bug, technical failure, unauthorized human intervention or other causes beyond Garmin’s control corrupt the administration, security, or proper play of the Sweepstakes, as determined by Garmin in its sole discretion. In such event, Garmin reserves the right to award the Prizes in a random drawing from among the pool of valid entries submitted up to the time of the impairment. Garmin reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Garmin reserves the right to seek damages from any such person to the fullest extent permitted by law. Garmin’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet service provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
10. PUBLICITY: Except in Tennessee and where prohibited by law, participation in the Sweepstakes constitutes the winner’s consent to Garmin’s use of winner’s name, likeness, photograph, voice, story or testimonial, and state of residence for promotional purposes in any media without further payment or consideration.
11. PRIVACY: All information submitted by entrants as part of this Sweepstakes will be treated in accordance with Garmin’s Privacy Statement, which is accessible from www.garmin.com.
12. LIMITATIONS OF LIABILITY: Garmin and its affiliates and employees, and Fox, Twentieth Century Fox Television and Imagine Television, and their respective affiliates and employees, are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Sweepstakes; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt of any prize.
13. DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Sweepstakes, but in no event attorneys’ fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Garmin in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Kansas.
14. OFFICIAL RULES AND WINNERS LIST: A copy of these Official Rules will be posted on www.garmin.blogs.com. You can obtain Sweepstakes winners and a copy of these Official Rules by sending a self-addressed, stamped envelope to Garmin International, Inc., Attn: Marketing Communications, 1200 East 151st Street, Olathe, Kansas 66062. Vermont residents may omit return postage for Official Rules requests.
