1. ELIGIBILITY: The Sweepstakes is open only to individuals who are legal residents of the fifty (50) United States (excluding Rhode Island and Puerto Rico residents) or the District of Columbia and are eighteen (18) years of age or older at the time of entry. Additionally, all entrants must have internet access and a Twitter account. Twitter accounts are free. Employees and their immediate families of Garmin International, Inc. and any of Garmin's affiliated companies are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
2. AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of Garmin, which are final and binding. Winning the prize is contingent upon fulfilling all requirements set forth herein in a timely manner.
3. SPONSOR: Garmin International, Inc. located at 1200 E. 151st Street, Olathe, KS 66062 is the sole sponsor of this promotion ("Garmin"). Twitter.com is not affiliated with this Sweepstakes in any way and is not responsible for the administration of the Sweepstakes or the awarding of prizes.
4. SWEEPSTAKES TERMS: This Sweepstakes will be conducted as five (5) separate weeklong periods as follows:
Week1 Term: Commencing at 12:01 p.m. Central Time ("CST") on Friday, August 20, 2010 and will continue until 11:59 a.m. CST on Friday, August 27, 2010 (hereinafter "Week1").
Week2 Term: Commencing at 12:01 p.m. CST on Friday, August 27, 2010 and will continue until 11:59 a.m. CST on September 3, 2010 (hereinafter "Week2").
Week3 Term: Commencing at 12:01 p.m. CST on Friday, September 3, 2010 and will continue until 11:59 a.m. CST on September 10, 2010 (hereinafter "Week3").
Week4 Term: Commencing at 12:01 p.m. CST on Friday, September 10, 2010 and will continue until 11:59 a.m. CST on September 17, 2010 (hereinafter "Week4").
Week5 Term: Commencing at 12:01 p.m. CST on Friday, September 17, 2010 and will continue until 11:59 a.m. CST on September 24, 2010 (hereinafter "Week5").
(The five separate weeklong sweepstakes Terms are collectively referred to as "Garmin Twitter Sweepstakes" or "Sweepstakes"). All times Central Time ("CST"). Entries must be received via Twitter, during the applicable weeklong Sweepstakes Term. See "Entry" for details.

Register by signing in to your Twitter account (if you do not have a Twitter account, visit www.twitter.com to create one). Twitter accounts are free. Once logged into your Twitter account, become a follower of @Garmin. To become a follower of @Garmin, go to the @Garmin official Twitter site at: http://twitter.com/Garmin and click the "Follow" button.

The tweets must follow these formats exactly in order to qualify for entry.
Entries must be received via Twitter during the applicable weeklong Sweepstakes Term (see Sweepstakes Terms) in order to be eligible for that week's drawing. A valid entry during one of the Sweepstakes Terms will not qualify as entry for a subsequent term; a separate tweet/retweet entry is required for entry into each Sweepstakes Term. Entries will not be acknowledged. You may also review these instructions in Garmin's Sweepstakes call to action posted by Garmin on http://www8.garmin.com/buzz/nuvi3700/rules.html. If your Account is in "protect mode", your updates/responses will not be visible in Sponsor's @Reply inbox; and, therefore, will not be received by Sponsor, resulting in your failure to enter any Sweepstakes. Normal Internet access and usage charges imposed by your online service will apply. If you opt to receive Sponsor's tweets via your wireless mobile device (which may only be available via participating wireless carriers), standard text messaging rates, airtime and carrier charges will apply for each text message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. You understand that by participation in these Sweepstakes via mobile phone or text message, if you are a potential winner, the Sponsor may contact you via mobile phone or text message, which will be subject to the charges pursuant to your carrier plan. It is your sole responsibility to notify the Sponsor in writing if you change your Account.
6. ENTRY LIMITATIONS: Limit one entry per person per week and per Twitter account used to submit an entry. Although subsequent attempts to enter may be received, only entrant's first entry will count. Multiple entrants are not permitted to share the same Twitter account. Additionally, anyone found to use multiple accounts to fraudulently enter in excess of entry limits will be ineligible. Entries using automated means to follow, tweet or otherwise participate are not eligible. Use of any automated system to enter as determined by Sponsor in its sole judgment is prohibited and will result in disqualification at Sponsor's sole discretion. ALL ELIGIBLE ENTRIES WILL BE ENTERED INTO THE SWEEPSTAKES FOR THE APPLICABLE SWEEPSTAKES TERM. Potential winners randomly drawn during previous Sweepstakes Terms may not enter into subsequent Sweepstakes Terms. Entries by any method other than set forth in this Section are void. Garmin is not responsible for entries that we do not receive for any reason. Any attempted entries not received by Garmin will not be included as valid, eligible entries.
7. PRIZE: Ten (10) Prizes (two (2) for each of the five (5) Sweepstakes Terms): Two (2) grand prize winners will be chosen among the total Sweepstakes entries for each of the five (5) Sweepstakes Terms to win a Garmin nüvi® 3790T. Each Garmin nüvi® 3790T has an approximate retail value ("ARV") of $449.99. Total ARV of all prizes equals $4,499.90. The ARV of electronic prizes is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules. We will determine the value of the prize to be the fair market value at the time of prize award. Each Prize is nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Garmin, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by Garmin in its sole discretion. Winners are responsible for any taxes associated with receipt of the Prize.
8. DRAWING: The potential winner of each Prize will be chosen in a random drawing from the pool of valid entries received during each of the five (5) Sweepstakes Terms within seventy-two (72) hours after the conclusion of each Sweepstakes Term. Odds of winning depend on the number of eligible entries received in each Sweepstakes Term. The random drawings will be conducted by one or more employees of Garmin or an independent fulfillment entity.
9. NOTIFICATION OF POTENTIAL WINNER: Within ten (10) business days of each of the five (5) drawings Garmin will (a) send a tweet announcing the potential winner; and (b) send each potential winner a direct message from @Garmin to the potential winner's Twitter account used to enter the Sweepstakes with instructions on how to claim the price. In order to receive a direct message from Sponsor, you must (a) be following @Garmin and (b) have your account settings set to "unprotected" and/or "public." If a winner of a Prize cannot be located or does not respond within ten (10) business days of contact from Garmin, the Prize may be forfeited and an alternant potential winner will be drawn from the pool of remaining valid entries for the applicable Sweepstakes Term. Garmin and its affiliates, or their respective officers, directors, employees, representatives and agents will not be liable for unsuccessful efforts to notify a winner.
10. REQUIREMENTS OF THE POTENTIAL WINNER: To claim the prize, you will be required to respond by email and provide your full name, email address, physical mailing address and phone number to this email address: Garminblogs@garmin.com. Except where prohibited by law, the potential winner(s) will be required to complete and return an affidavit of eligibility (the "Affidavit") within ten (10) days of being notified. If a potential winner fails to sign and return the Affidavit postmarked within the required time period, an alternant entrant may be selected in his/her place from all of the qualifying entries received during the applicable Sweepstakes Term. If the potential winner declines the prize, does not respond to the prize notification, fails to claim the prize, is unavailable for prize fulfillment, fails to abide by the Official Rules, or is ineligible, Garmin may select an alternant winner from all remaining eligible entries received during the applicable Sweepstakes Term.
11. PRIVACY: Garmin will be collecting personal data from the potential winner when the winner has been selected in order to confirm Sweepstakes eligibility. Garmin will treat this data in accordance with its privacy policy, located at http://www8.garmin.com/privacy/. In addition, Garmin may use and share your personal data with third parties to the extent necessary to fulfill its obligation to administer and sponsor this Promotion. All entries to Twitter are subject to the Twitter privacy policy, located at http://twitter.com/privacy and are subject to the Twitter terms of service, located at http://twitter.com/tos.
12. GENERAL CONDITIONS: Garmin reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, virus, or other technical problem corrupts the administration, security, or proper play of the Sweepstakes, as determined by Garmin in its sole discretion. In such event, Garmin reserves the right to award the Prize at random from among the eligible entries received up to the time of the impairment. Garmin reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Garmin reserves the right to seek damages from any such person to the fullest extent permitted by law. Garmin's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the email address used to register at Twitter.com for the Twitter account used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned the Twitter account by Twitter. Each potential winner may be required to show proof of being the authorized account holder.
13. PUBLICITY: Notwithstanding any other term herein, except where prohibited, submission of any entry constitutes the entrant's consent to use of his/her name, likeness, voice, state of residence, biographical and prize information, statements about the promotion and/or the entrant's photo for advertising and promotional purposes without compensation.
14. LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, you agree to release and hold harmless Garmin, its parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including but not limited to: (a) any inaccurate information, whether caused by entrants or printer errors; (b) unauthorized human intervention in any part of the Sweepstakes; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in party, from the entrant's participation in the Sweepstakes or receipt of any prize. WITHOUT LIMITING THE FOREGOING, EVERYTHING IN THESE RULES AND IN THIS PROMOTION, INCLUDING THE PRIZES AWARDED, IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. 15. DISPUTES: Except where prohibited by law, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Sweepstakes, but in no event attorneys' fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of Garmin in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Kansas.
