Wherigo Builder Contest

NO PURCHASE NECESSARY TO ENTER OR WIN.  MUST BE 18 YEARS OF AGE OR OLDER TO ENTER.  VOID WHERE PROHIBITED BY LAW.

Wherigo Background:

Using the Wherigo Builder application, Wherigo authors can build interactive adventure games, tour guides, and other innovative activities for Wherigo players to enjoy outdoors.  Once the author is finished creating the experience, it is uploaded to the Wherigo site as a self-contained Wherigo file, called a cartridge. The published file is made available at www.wherigo.com to be downloaded by players equipped with the Wherigo Player application.

Contest Description:

Garmin is giving away one limited-edition geocoin per week during the Contest Term to recognize one noteworthy Wherigo cartridge per week.  Contestants must go to wherigo.com to build a Wherigo cartridge, and then send an e-mail with a brief description to Jake Jacobson at garminblogs@garmin.com to let him know that your cartridge is on wherigo.com.  Winners will be chosen on a number of subjective factors, including creativity, uniqueness, and innovation.

1. Eligibility:  The Contest is open only to individuals who are legal residents of the fifty (50) United States (excluding Puerto Rico) or the District of Columbia and are eighteen (18) years of age or older at the time of entry.  Employees and their immediate families of Garmin International, Inc. and any of its affiliated companies are not eligible.  The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. 
2. Agreement to Official Rules:  Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Garmin, which are final and binding. 
3. Contest term:  The Contest begins at 12:00 p.m. Central Time (“CDT”) on March 4, 2008 and will continue for a limited time until a termination notice is provided by Garmin on the http://garmin.blogs.com/ site.  Entries received prior to or after the Contest Term will be disqualified.
4. Entry:  NO PURCHASE IS NECESSARY.  Each contestant may submit an entry by (i) visiting the wherigo.com website and building a Wherigo cartridge; and (ii) sending an e-mail with a brief description to Jake Jacobson at garminblogs@garmin.com to let him know about your Wherigo cartridge(es).       Garmin and its affiliates do not assume any responsibility for any requirements of the wherigo.com website or for any lost entries or any computer, internet, or technical malfunctions that might occur during the entry process.  Each eligible entry is eligible for judging during that weekly period only.  For purposes of this Contest, the weekly period shall mean the period from Tuesday at 12:00 p.m. CST through the following Tuesday at 11:59 a.m. CST.  Each person is eligible to win only once (one geocoin) throughout the term of the Contest, however, contestants are free to enter new entries in separate weeks if they wish.  Entries containing defamatory, libelous, infringing, obscene, harassing, or other unlawful material or content will be rejected by Garmin at its discretion.
5. Prizes:  One limited-edition geocoin will be awarded each week during the Contest Term.  Each geocoin awarded has an approximate retail value of $5.  Each Prize winner will be eligible to win one (1) Prize only throughout the duration of the Contest. 

Prizes are nontransferable and non-refundable and must be accepted as awarded.  No cash or other substitution may be made, except by Garmin, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by Garmin in its sole discretion.  Winners are responsible for any taxes associated with receipt of the Prize.

Judging criteria:  Contest winners will be chosen at Garmin’s discretion based upon subjective factors such as creativity, uniqueness, and innovation.  Odds of winning depend on the number of eligible entries received during each weekly period.  Winners will be announced via the http://garmin.blogs.com/ site once per week during the Contest Term.
2. General Conditions:  Garmin reserves the right to cancel, suspend, and/or modify the Contest if any fraud, virus, or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by Garmin in its sole discretion.  Garmin reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.  Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law.  Garmin’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
3. ownership and Publicity:  Except where prohibited by law, participation in the Contest constitutes each Prize winner’s consent to Garmin’s use of each Prize winner’s name, likeness, photograph, voice, winning cartridge, and state of residence for promotional purposes in any media without further payment or consideration.
4. Limitations of Liability:  Garmin and its affiliates and employees are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Contest; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Contest or the processing of entries; or (e) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize. 
5. Disputes:  Except where prohibited by law, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contest, but in no event attorneys’ fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Garmin in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of Kansas.
6. Official Rules and Winners List:  A copy of these Official Rules will be posted on http://garmin.blogs.com/.  A list of winners will be posted on http://garmin.blogs.com/.  You can also obtain Contest winners and a copy of these Official Rules by sending a self-addressed, stamped envelope to Garmin International, Inc., Attn: Jake Jacobson, 1200 East 151st Street, Olathe, Kansas 66062.  Vermont residents may omit return postage for Official Rules requests.
